Insurance Law Update: Drive-By Shooting Not Covered By Uninsured Motorist Coverage
The tragic case of a mother who was struck and left paralyzed by an errant bullet fired from a van during a drive-by shooting was recently considered by the Ontario Court of Appeal. The mother sued the driver of the van as well as her own automobile insurer. At issue was whether the injuries arose “directly or indirectly from the use or operation of an automobile”.

Hands On The Wheel, Eyes On The Road
Starting this Fall, talking on your cell phone, texting on your blackberry and, even watching your favourite DVD while you drive, will be prohibited. The Ontario government is poised to implement the Countering Distracted Driving and Promoting Green Transportation Act, 2009 which will include amendments to the Highway Traffic Act, to impose additional penalties on drivers. The penalties will affect not only drivers, but potentially also employers whose employees cause accidents while violating these new provisions.
